Many debt-buyer cases fall apart when the plaintiff is actually required to prove its claim. Dismissals commonly come from one of a few reliable pressure points.
Common grounds
- Lack of standing — the plaintiff can't produce the complete chain of assignment
- Expired statute of limitations — the suit was filed too late
- Insufficient evidence — no signed agreement, no account-level records
- Defective service — you were never properly served
How to push for it
Answer on time, raise your defenses, and use discovery to demand the documents the plaintiff must have. When it can't produce them, move for dismissal or summary judgment — or the plaintiff walks away first.
