Summary judgment lets a plaintiff win without trial by arguing there's no genuine dispute of material fact. Debt buyers lean on it heavily, usually supported by a robo-signed affidavit from an employee with no personal knowledge of your account.
How to oppose it
- Point to genuine factual disputes — the amount, ownership, or the account's authenticity
- Challenge the affidavit's foundation and admissibility
- Highlight gaps in the chain of assignment
- Note missing business-records foundation for the account documents
